10:30-12:15PM Practical Strategies for Conducting Workplace Investigations and Eliminating Unconscious Bias from  the Investigative Process, Joshua Gessling

Program Summary

Josh will introduce practical strategies aimed at formalizing the workplace investigative process and eliminating unconscious bias from the process. Attendees will learn about the sources of law and policy that can give rise to the obligation to investigate, practical tips on formalizing the investigative and complaint intake process, and post-investigative considerations. The segment will feature a mock investigative interview applying principles introduced during the workshop. 

 

Joshua Gessling Bio - 

Josh represents public and private employers in a broad range of labor and employment law matters. Josh devotes a substantial portion of his practice to counseling employers on strategies to avoid labor and employment-related claims, developing employee handbooks and policies, and conducting workplace investigations and training. When litigation cannot be avoided or is preferred, Josh defends employers in federal and state courts and before local, state, and federal administrative agencies.

Josh is a member of the Society for Human Resources Management (SHRM), is a member of the Board of Directors for the Evansville-Area Human Resource Association (EHRA) and serves as its Legislative Affairs Chairperson, and is the former Chairman of the Evansville Bar Association’s Labor and Employment Law Section. Josh’s labor and employment practice spans several industries, including manufacturing, government, finance, construction, health care, education, and transportation. He is licensed to practice law in Indiana and Florida and has been admitted to practice on a pro hac basis before several other state and federal courts.

Program Summary

Have you heard the term uniqueness + belonging = inclusion? How do we as HR professionals create an environment where people feel the freedom to bring their whole self to work, knowing their ideas will be heard and their contributions will be valued?  It’s a tall order!

Creating an inclusive workplace goes beyond diversity to fostering inclusion. 

In this session we will cover:

  • Uniqueness + Belonging = Inclusion
  • Our unique contributions combined with our need to belong in our work groups and organizations
  • The difference between inclusion and diversity
  • What an inclusive workplace looks like
  • Define hidden bias, microaggression

 

This focuses on the SHRM BoCK Interpersonal cluster, in both Communication, and Global & Cultural Effectiveness behavioral competencies.  Additionally, it covers the HR knowledge area of Diversity and Inclusion, in the Workplace domain.

Our session will be hands-on, interactive, and include a variety of lectures using short videos, small group discussions and group activities.  Our goal is to encourage participants to be engaged and participative.  A typical session includes 30% lecture, 15% videos, 30% small group activities or discussions and 25% full group activities or discussions.  Our philosophy is that participants should learn as much from each other as they will from the facilitator.

 

Erin Brothers Bio -

Erin is the Director of Consulting Services with Purple Ink. She has 15 years HR experience, most recently as HR Director for the last five years in the professional motorsports industry. Prior to that, Erin

worked in the healthcare industry for ten years. She started her HR career working with individuals with disabilities, helping them become gainfully employed. Erin enjoys the responsibility of all aspects of the Human Resources function for small single owner companies to large corporations.

Erin’s bachelor’s degree is from Butler University. She earned her MPA from Indiana University’s School of Public and Environmental Affairs with a focus on Human Resources. She also has a certificate in Alternative Dispute Resolution from IU’s McKinney School of Law.

She is currently the Director of Diversity and Inclusion for IndySHRM; Carmel Library Foundation Board member; Pass the Torch for Women mentor and 500 Circle Member; and serves as a Small Group Leader at College Park Church, where she is a member. She has been an active member of the Society for Human Resource Management and IndySHRM for 14 years.

Chad Sullivan Bio - 

 

Chad frequently represents and counsels’ clients on a variety of matters across a number of industries. He advises employers on a variety of labor and employment issues, including covenants not to compete, wage and hour, civil rights discrimination, unfair labor practices, Family and Medical Leave Act (FMLA), sexual harassment, union avoidance, union elections, and wrongful discharge. He also drafts companies’ employee policies and procedures and reviews those already in place for compliance. As part of his practice, he has defended clients before the National Labor Relations Board (NLRB), Equal Employment Opportunity Commission, numerous state and federal courts and state and local Human Rights commissions.

Chad also represents businesses and trustees in complex litigation, involving such issues as trade secrets, breach of contract, fiduciary duties, securities, and business torts. Additionally, Chad represents the coal and oil and gas industries in litigation issues, ranging from royalty disputes, lease interpretation, slurry injection rights, coalbed methane and other mineral ownership issues, objections to longwall mining, and determination of working interest ownership.

Chad is also involved in the legal community and the community at large – he is a frequent speaker on labor and employment law topics, knowing that it’s important to ensure his clients are up-to-date on the latest changes to the law. He also supports the local and national election process through his roles as a precinct committeeman and as an Indiana Republican Delegate.
